constitutional Court has published the verdict regarding the issue of the decree of March 6, 2026, of President Vjosa Osmani, which dissolved the Assembly of Kosovo.

According to the judgment dated March 25, 2026, the Presidential Decree has been declared invalid and has no legal effect.


The Court finds that the members of the Assembly have 34 days to develop and complete the procedure for electing the President, and if this is not accomplished within this period, the Assembly is automatically dissolved according to the Constitution and early elections will be organized.

The court also annulled the previous decision on the interim measure issued on March 9, 2026 and ordered the publication of this judgment in the Official Gazette of Kosovo.

As a result, the Constitutional Court has declared the request of Prime Minister Albin Kurti on behalf of the Government and that of Arbërie Nagavci on behalf of 30 MPs admissible and has concluded that President Vjosa Osmani's decree to dissolve the Parliament does not produce any legal effect.

The Court found that the Assembly constituted on February 11 did not have 60 days at its disposal, within which the procedures for electing the President should have been completed, a deadline set out in subparagraph 3 of paragraph 1 of Article 82 of the Constitution.

"However, referring to subparagraph 3 of paragraph 1 of Article 82 of the Constitution, which stipulates that the Assembly shall be dissolved in the event that 'if within a period of sixty (60) days from the date of commencement of the election procedure, the President of the Republic of Kosovo is not elected', the Court, taking into account the specific context of the circumstances of the constitution of the Assembly on February 11, 2026, assessed that the Assembly did not have sixty (60) days at its disposal, within which period the procedure for the election of the President should have been completed," the judgment states.

The judgment enters into force immediately.

This decision emphasizes the importance of respecting the legal deadlines for the election of institutions and foresees the consequences in case of failure to act within the established deadlines. /Telegrafi/
