The prosecution intends to call three witnesses in the case of Thaçi, Smakaj, Kuçi and others

Prosecutor Joshua Hafetz said that they intend to call three witnesses in the judicial process in The Hague against Hashim Thaçi, Bashkim Smakaj, Isni Kilaj, Fadil Fazliu and Hajredin Kuçi.

"It is true that we intend to call three witnesses at least, including the one who is mentioned by name or on whom is the supporting documentation of the indictment," said prosecutor Hafetz.

Speaking about the release of materials and information related to the things confiscated from the accused, prosecutor Hafetz said that they have Kilaj's and Fazli's phone.


During their submissions, Smakajt's defender, lawyer Bes Martenes, said that they have a document that provides information regarding the evidence. However, he says that everything related to his client is redacted and extracted, and in particular related to the documents that were seized during the search of his apartment.

As an example, Martenes pointed out that the information on telephone data is very limited.

"The defense cannot currently conduct any investigation and cannot do anything in terms of defense reserves and approaches so that it can proceed with its own investigations. We are reserving the right to take steps when it is appropriate," said Martenes, reports "Oath for Justice".

Meanwhile, Michiel Pestman, who represents Fadil Fazliu, said that he, as his lawyer, has not seen his client's phone at all, specifically in the document that provides information about what was on Fazliu's phone.

However, Judge Marjorie Masselot said it could probably be related to the technology aspects, because the lawyer would have to have access to that document.

Lawyer Pestman said he wants to know which Prosecution witnesses are related to the accused and if they will speak for his client.

The lawyer Alexander Admiral, who represents Hajredin Kuçi, had no submissions. Whereas, that of Isni Kilaj, Iain Edwards, said that he has only one point to raise. He said that in his opinion, the Prosecutor's Office does not have the right to say that it is premature for lawyers to be involved in discussions regarding the information found on the phones of the accused.

Pestman stressed that the information found on his client's phone should not be presented to other parties.

On the other hand, the prosecutor Joshua Hafetz said that they will be involved in discussions with the parties regarding the information that was found on the phone seized from their clients.

He said that the demands of the defense to be included in the discussions are premature. However, he emphasized that they will not extract materials from the phones of the accused that contradict the rules, but only that information related to the case.

According to Masselot, the defense of Thaçi and Kilaj have said that they are not yet in a position to give submissions currently regarding the investigations that the defense will carry out, considering that no material has been received in this regard.

Likewise, Martenes, who represents Smakaj, said that they are waiting for the materials and then they will see what their position is.

Pestman, who represents Fadil Fazliu, said that it is premature to answer this question. The submissions were joined by the holding of Kilaj and Kuci.
