The opposition claims that the 2025 budget is anti-constitutional, what if it is sent to the Constitutional Court?

The opposition has repeatedly proclaimed that the budget approved in the Assembly of Kosovo for 2025 is anti-constitutional, being tied to the way of increasing salaries in the public sector. Even though there is no warning from them, the consequences would be great in the country's economy if it is sent to the Constitutional Court, political analysts say that if the opposition does not act like this then this cause is only being used for the electorate.

In plenary sessions, in television studios, and through posts on social networks, they repeatedly said that the 2025 budget is anti-constitutional.

However, the opposition parties have mostly left this as such, except as a statement.


But do they have the right to send the same to the Constitutional Court after approval in the Assembly of Kosovo and what happens?

"According to Article 113, no less than 10 deputies have the right to turn to the Constitutional Court to evaluate whether it is in accordance with the constitution either from the content or from the procedure, in such cases normally the request has a suspensive character, which means that it stops apply until the Constitutional Court decides on the same", said Ardian Bajraktari, lawyer.

According to him, such a decision could take up to 6 months and this would mean great economic losses for the country.

"It would create great implications, and the implementation of the budget for 2025 could not begin, and as a result we will move to the transitional phase in which only payments will be made on the revenues foreseen in the budget law and laws others in force and I cannot start any capital project foreseen for the period of 2025", stated Bashkim Mustafa, economist.

But, according to political analysts, if the opposition only calls it that and does not take any steps, then everything is being done for a campaign and not because it has a serious cause.

"If the political subjects are really serious about it, they should send it to the Constitutional Court and continue the procedures for the legal validity of the same, if the same is not done, then the opposition political subjects are just campaigning", stated Albinot Maloku, political analyst.

The argument of the opposition that the budget is unconstitutional is related to the salary increase, since according to them this cannot be done through the budget but through the increase of the coefficients from the Law on Wages.
