The complete file of the Prosecutor's Office: What did Minister Gërvalla not declare from the property and what did he declare to the Prosecutor's Office?

The Basic Prosecutor's Office in Pristina has filed an indictment against the Minister of Foreign Affairs and Diaspora, Donika Gërvalla, regarding the charge of not accurately reporting assets.

The "Oath of Justice" provided the full indictment, which turns out to have been compiled on January 31, 2023, by prosecutor Astrit Gashi.

According to the indictment, Gërvalla is charged that, in the capacity of a senior public official with a legal obligation to declare wealth, in the form for declaration of wealth on March 22, 2021, she did not correctly submit the data required by law.

The indictment says that, in this form, she has not declared any income of her husband Stefan Schwarz, even though she has declared him as her husband.

Further, the charge states that Gërvalla has not fully declared the cadastral parcel-agricultural land in her ownership with an area of ​​3964 m2 in ZK Dubovik-Deçan Municipality, declaring only an area of ​​2000 m2.

Likewise, according to the accusation, Gërvalla is said to have not even declared the business "Alb Lingua UG" registered in Bonn, Germany, in her name, reports "Betimi per Justice".

With these actions, Gërvalla is accused of having committed the criminal offense of "non-reporting or false reporting of wealth, income, gifts, other material benefit or financial obligations", from article 430 paragraph 1 of the Criminal Code of the Republic of Kosovo.

The prosecution, through the indictment, has requested that she be declared guilty of the criminal offense charged and has proposed to the court to confiscate the undeclared value.

What did the Gërvalla ministry declare to the prosecution?

In relation to this criminal case, the accused Gërvalla-Schwarz gave a statement to the Prosecutor's Office in November 2022, where she stated that she was not aware that she had to declare her husband's income in the asset declaration form.

"Because I thought that the personal data of my husband, as a German citizen, without any physical or legal connection with Kosovo, is also protected in Kosovo by German law, especially since my husband has no movable or immovable property apart from his monthly salary which would be considered to be declared in that form", Gërvalla had stated.

Gërvalla had affirmed that he had made the first statement upon taking office on March 22, 2021.

"In the retrospective declaration of 2021, I also included my husband's income of around 54 thousand euros per year. This happened after I was informed by AKK that according to them the rich income of the foreign citizen must be declared. I am not very convinced that such a thing is true, but above all, to avoid misunderstandings, I included my husband in this statement," she said.

However, on the occasion of the declaration of taking office, she had stated that she was not interested in whether her husband's income should also be declared.

Whereas, regarding the land surfaces, Gërvalla had stated that in the village of Dubovik, she owns three plots which are family heritage.

According to her, the first plot is the land where the house is located, the second is marked as unused agricultural land and the third is unused mountain land.

In her family's house in Dubovik, she said that there lives a family of 4 members who are my father's cousins.

"In my determination about the areas of the plots, I have based my consultation with the resident of the house, considering that no one can make the assessment better than him. I personally have never had a certificate of ownership, but I know that I was informed years ago on the phone that such a certificate exists and was delivered years ago to the residents of our house in Dubovik", said Gërvalla.

Regarding the "Gërvalla" Foundation, she stated that since its establishment in 2006, the said foundation has never circulated a single cent either within Kosovo or abroad.

"I consider this year's criminal complaint, with the factual situation fully clarified and with complete clarity about my lack of motive to hide my assets, my income or any kind of financial activity of mine, motivated by political revenge and an attempt to denigrated the personality", Gërvalla stated in the prosecution.

Otherwise, on June 20, 2023, the initial examination of Donika Gërvalla failed to be held, because she did not have a lawyer engaged.

The Basic Prosecutor's Office in Prishtina, on May 29 of this year, has confirmed for the "Oath of Justice" that it has filed an indictment against Gërvalla.

After the news about the filing of the indictment became known, Minister Gërvalla, through a post on Facebook, said that it is an attempt to throw mud on the representatives of the institutions.

On October 2, 2021, the "Oath of Justice" reported that Donika Gërvalla, Deputy Prime Minister and Minister of Foreign Affairs and Diaspora (MPJD), has not declared all functions in local and international institutions.

Four months after this investigation, the Anti-Corruption Agency (AKK), now the Corruption Prevention Agency (APK), announced that it is still handling the case of Minister Gërvalla.
