Constituent session fails again – report on verification of MPs' mandates not put to vote

The session on the constitution of the Kosovo Assembly, which was scheduled to take place today, has failed to take place again. This is because the chairman of the constitutive session, Avni Dehari, invited representatives of political entities for consultation, but no compromise was reached between them.
The Speaker of the Assembly, Avni Dehari, said that representatives of political parties abandoned the consultations and as a result there was no compromise.
"The session will continue within 48 hours, on April 19 at 12:00, with the hope that there will be agreement by then," said Dehari.
The April 17 session was a continuation of Tuesday's session (April 15), where the report on the verification of MPs' mandates failed to be voted on.
After the failure of the session on Tuesday, the Speaker of the Assembly of Kosovo, Avni Dehari, wrote a letter to President Vjosa Osmani, informing her of the developments that occurred in the session and asking for suggestions on how to proceed.
And, after the letter, the president cited the Constitutional Court Judgment in Case No. K072/20, which states that constitutional structures should be interpreted in a way that "enlivens and does not block" the functioning of the powers that emerged from the vote of the citizens.

Acting Minister of Agriculture, Faton Peci, has reacted after the failure of the constitutive session of the Kosovo Assembly.
Peci, in his reaction, says that the opposition abandoned the consultative meeting, reports Telegrafi.
"Recidivists in mistakes! After denying mandates and blocking the first session of the Assembly, the opposition abandoned the consultative meeting, they failed again in the second attempt to contribute to an institutional solution," he stressed.

Haxhiu: We have the votes to form institutions, but consultations are needed to unblock the Parliament
Acting Minister of Justice, Albulena Haxhiu, has stated that the Vetëvendosje Movement has sufficient votes to form new institutions, but has underlined the importance of holding consultations to find a solution that would enable the unblocking of the process of constituting the Kosovo Assembly.
After the session was adjourned on Thursday by chair Avni Dehari, Haxhiu stated that the lack of consensus during the consultative meeting was the main obstacle to moving forward in this process.
"The chairperson adjourned the session due to the lack of consensus in the consultative meeting. The letter sent by the president to the chairperson requests a solution to avoid blocking the constitution, and this requires consultations. We cannot reach a solution without such a process," she stressed.
Haxhiu confirmed Vetëvendosje's readiness to contribute to any solution that would help overcome the impasse.
"As a political party, we are committed to correcting the wrong decision of the Assembly. We have full will to do this, but it is necessary to determine the most appropriate way to achieve it," Haxhiu added.

The leader of the Democratic Party of Kosovo (PDK), Memli Krasniqi, said that LVV usurped a constitutional and legal right of elected deputies.
After the closing of the constitutive session, he said that the LVV, which emerged victorious in the February elections, had organized a scenario to usurp the legislative body.
"You, the media and the citizens, witnessed that the party that came out first usurped a Constitutional right to obstruct the course of the session. They had a scenario in an organized manner. Here is the scenario. Today there was a party usurpation of the Kosovo institution," he said.
Krasniqi further invited the LVV not to hold the country's institutions hostage, reports the Telegraph.

The Chairman of the Democratic League of Kosovo, Lumir Abdixhiku, said that the citizens of Kosovo now have a very clear idea of who are blocking the constitutive session.

AAK's Kadrijaj: The session should continue where it left off, not form the Ad hoc Committee again
Time Kadrijaj from the Alliance for the Future of Kosovo, in a statement to the media, said that the session should continue where it left off and not form an Ad hoc Commission again.
She said that no additional consultations should be called, but that the session should continue where it left off.
"... there was an Ad hoc committee that completed its work, the report was brought to the Assembly, it was necessary to continue where the process left off...", she said.
Kica-Xhelili from LDK: The consultative meeting invited by Dehari is an unprecedented case
Doarsa Kica-Xhelili from LDK said that this is an unprecedented case, as the chair of the session does not have the right to invite party actors to a consultative meeting at this stage.
She told the media that what needs to be done at this stage is to put the report to a revote.
"What the chairman just did is unprecedented... the chairman has no right to invite the actors in this case. What I can do is put the report to a re-vote. LDK representatives went to discuss this issue. There is no need to invite political parties at this stage," she said.
Furthermore, our position does not change and the only unprecedented way is how they behave with the rules of the Kosovo Assembly.
Meanwhile, Hykmete Bajrami from this party said that they did not discuss anything in this consultation meeting.
"Because Dehari has no right to call members of political parties for consultation," she said.

The leader of the Alliance for the Future of Kosovo (AAK), Ramush Haradinaj, said he hopes that "the issue of resignations will be resolved" while emphasizing how AAK is interested in the constitution of the Assembly. But he said that they cannot vote for "legal violations."

Abdixhiku: LDK does not vote on the report on the verification of the deputy's mandate
The leader of the LDK, Lumir Abdixhiku, has declared that they will not vote on the report on the verification of the deputy's mandate.
Abdixhiku declared that they cannot violate the Constitution.
"Unchangeable position, We cannot vote for a violation of the Constitution. LDK deputies cannot violate the Constitution. Simple logic, you cannot be both a deputy and a minister. Our position remains the same," the LDK leader told the media.

Kurti enters Parliament, doesn't answer if they have secured the numbers
The acting Prime Minister, Albin Kurti, has already entered the Kosovo Assembly where the session for the constitution of the ninth legislature is expected to begin.
He has not revealed to the media whether he has the numbers to constitute the Assembly.
The session on the constitution of the Kosovo Assembly is expected to continue today at 12:00.
LVV MP denies having an agreement with the Social Democratic Initiative
LVV MP Arbër Rexhaj stated that they have the numbers to form the Government, while also saying that they now also have the name of the Speaker of Parliament.
However, Rexhaj asserted that it is up to the acting Prime Minister, Albin Kurti, to publish the name of the Speaker of Parliament as well as the composition of the government cabinet.
"The Prime Minister has the name, he will reveal it to the citizens. It is up to him, we do not have any agreement with the Initiative," he said.

Acting Minister of Foreign Affairs, Donika Gërvalla, stated that if the opposition does not block the constitution, they will continue with the procedures.
Asked by journalists if they have any agreements with political entities, she said that this will be seen today.
"It remains to be seen today, everything depends on the will of the opposition. The President has shown you that the constitutive session is not held to block, but in the sense of unblocking. We are assured that the session is continuing," said Gërvalla.
AAK MP Kadrijaj: We have red lines for LVV
Alliance for the Future MP, Time Kadrijaj, before entering the Parliament hall, declared that they only have red lines for the Vetëvendosje party.
She told the media that they will talk to the MPs about whether they will vote on the report verifying the MP's mandate, since Albin Kurti has not resigned from the post of Prime Minister.
"We have not had discussions with LVV, we have red lines. We do not know who will be the candidate for Speaker of the Assembly," she said.
