The member of the leadership of the Democratic Party of Kosovo, Pëparim Gruda, has accused the Kurti Government of politicizing and destroying the public administration.

Gruda, in a media conference, said that the initiative to amend the Law on Public Officials contradicts the Constitution of Kosovo and the Stabilization and Association Agreement that Kosovo has with the EU.


"This law violates the Stabilization and Association Agreement for Kosovo, because its article 120 requires cooperation with the European Union in the field of public administration reforms. It is worth noting that the EU Office in Kosovo has also opposed this law. Article 19 of the Constitution clearly defines that ratified international agreements have precedence over the laws of the Republic of Kosovo. Therefore, the Law on Public Officials cannot be in conflict with the SAA because it is also in conflict with the Constitution", Gruda emphasized.

He said that many of the court's remarks regarding this law have not been addressed, even though the Government was obliged to do so and there was no public consultation on it.

"The incumbents have a mandate of 12 months with the possibility of extension for another 12 months. Article 17, paragraph 3 says: "Civil servants appointed to positions of the lower and middle management category before the entry into force of the basic law are considered to begin their first term with the entry into force of this law". This is completely contrary to the judgment of the Constitutional Court. Article 11, paragraph 5, defines: "If, within the period of nine (9) months, the civil servant is not organized or refuses to be organized in any vacant position of the civil service, the civil servant is released from the civil service". This is a mechanism for blackmail and dismissal of public servants", explained Gruda.

He said that the completion and amendment of the Law on the Prosecutorial Council is unconstitutional.

"This is being done with a tendency for political influence on the prosecution body, because its composition is contrary to the judgment of the Constitutional Court, both in terms of the inclusion of politics in the KPK and the inclusion of a member from the People's Advocate", Gruda said. .

PDK has called on the Government to stop actions that contradict the Constitution, the SAA and the judgments of the Constitutional Court, otherwise it will send these laws to the Constitutional Court. /Telegraph/
