At the end of October, the Government of Kosovo decided to increase salaries in the public sector.
This increase was announced to be done in two phases and the first phase was said to start in January 2025.
Consequently, 55 euros from this month, and another 55 euros from July.
This was done through the Budget Law, increasing the coefficient depending on the position by 0.5 units for the first six months of the year, and also by 0.5 units from July.
But as at the time when the decision was announced, as now when the time for its implementation is approaching, legal dilemmas still exist.
The increase of the units through the budget and not the increase of the coefficient through the amendment of the Salary Law continues to be considered illegal by the jurists.
"Any intervention in the structure of the coefficient in accordance with Article 42 of the Salary Law is against the law, therefore the insistence and proceeding in this form, as it has been done in my opinion, is in complete contradiction with the provisions of the law on salaries in the public sector", lawyer Ardian Bajraktari stated for TV Dukagjini.
While the other lawyer, Anton Nrecaj, is saying that this situation is confusing because, according to him, the legal provisions resulting from the recommendations of the Constitutional Court for the Salary Law have not been completed.
"Any kind of decision that will be issued will be a double-edged sword for the Government of the Republic of Kosovo, because it neglected, or rather did not respect the decision of the Constitutional Court in order to end the epilogue of the salary law drama in the public sector", stated Nrecaj.
According to legal experts, the legal problems of the decision to increase salaries can only be ascertained by the Constitutional Court.
But, despite the dilemmas raised publicly, none of the authorized parties in the political field has sent this decision to the constitutional court.
