The Supreme Court of Kosovo is expected to make a decision today on the complaints of political entities and candidates for deputies regarding the elections held on February 9.
The Supreme Court said that the decision on the appeal of the Vetëvendosje Movement for the cancellation of LDK's postal votes will be made within the time limit provided for by the law in force.
On the other hand, the Central Election Commission is awaiting the decision of the Supreme Court to then proceed with the certification of the final results.
However, experts in the electoral process tell KosovaPress that the Supreme Court will overturn the LVV annex, as will the Electoral Panel for Complaints and Appeals, and thus the CEC will be able to certify the election results this week.
The spokesperson for the Supreme Court, Antigona Uka-Lutfiu, announced that the appeal of LVV and the PDAK-LPB coalition against the ECAP decision will be decided on Wednesday, March 26, when the legal deadline of 5 days ends.
The Vetëvendosje Movement filed an appeal on March 21st with the Supreme Court against the ECAP decision that rejected their appeal for the cancellation of LDK's postal votes and their request for a postal re-vote.
"That for two complaints, received on March 21, 2025, an appeal from the Vetëvendosje Movement, filed against the ECAP decision, and an appeal from the PDAK-LPB Coalition, filed against the ECAP decision, will be decided within the legal deadline of 5 days, which is calculated from the date of receipt of the complaint, including the weekend," the Supreme Court's response states.
And the spokesperson for this CEC, Valmir Elezi, says that depending on the Supreme Court's decision, they will implement them if they have obligations for the CEC and then it will be able to proceed with the certification of the final election results.
"Currently, the electoral process is in the phase of complaints against the final results announced by the CEC on March 15, 2025. The Central Election Commission will await the decisions of the relevant institutions, implement them if they have obligations to the CEC, and then it will be able to proceed with the certification of the final results," Elezit's response states.
On the other hand, university professor and expert on electoral processes, Mazllum Baraliu, says that the greatest possibility is that the Supreme Court will also reject the LVV's appeal for the cancellation of the LDK's postal votes and the postal re-voting.
According to him, once all appeal and administrative procedures are completed, the CEC is likely to certify the final results of the February 9 elections on Friday or Saturday of this week.
"As soon as all appeal and administrative procedures are completed [the results can be certified]. The CEC has the opportunity to meet on Friday, or even Saturday if necessary, to certify the results. After that, the CEC sends the lists of election results to the Assembly of Kosovo and the Presidency. The President of the country is obliged to schedule the session for the constitution of the Assembly within 30 days after certification," explains Baraliu.
Certification of the final results of the February 9 elections would pave the way for the legal deadlines for the constitution of the Kosovo Assembly to expire.
Kosovo held general parliamentary elections on February 9, 2025. Meanwhile, the CEC announced the final results on March 15.
Based on the final results of the February 9 elections, the Vetëvendosje Movement came first with 42.30 percent of the votes, the Democratic Party of Kosovo 20.95 percent, the Democratic League of Kosovo 18.27 percent, and the AAK-Nisma coalition 7.06 percent.
Based on these figures, the Vetëvendosje Movement will have 48 MPs, PDK 24, LDK 20, AAK-Nisma 8, and non-majority communities 20 MPs.
According to the results, no party can form the government alone.
