The accused in the murder case at the "BonVivant" bar, Andi Pajaziti, has given his defense regarding the charges brought against him by the prosecution.
Pajaziti is accused of committing murder in a state of severe mental shock, resulting in the death of a person on 04.08.2023.
Andi Pajaziti said that he woke up that day in a serious emotional state and did not leave the house until 21:00 PM, when he went out to eat and went to the Vranjevc neighborhood to look at some cars to buy.
Upon returning from this neighborhood, the same people had stopped for a drink at the "BonVivant" bar, as there was a large line of people on "Qafa" street.
The same person said that he, along with three other people, had entered the bar where a waiter had told them to "wait standing until there was a place to sit."
Further, Pajaziti said that Dukagjin Lekaj had invited him to sit at the table to drink, but that according to Pajaziti, the way to the table was accompanied by behavior that he understood after the incident had occurred.
According to Pajaziti, Dukagjin Lekaj had touched him on the lower back to see if he had a weapon with him, but he said that he had the weapon in the front of his body.
"He told us if we wanted to wait a little while standing until I found a table because there were a lot of people. While waiting for a moment, Dukagjin Lekaj approached me and we greeted each other and told me to come to the table and have a drink because I had something with me. I accepted because I have known the same person for about 10 years and I have never had anything bad with him and I added that I thought he was calling me about a car that he had offered to sell me two days before. And after we went to the table, to his table, on the street, Dukagjin touched me in the groin, but at that moment I was not impressed why he was touching me. But after the incident happened, analyzing it, I came to the conclusion that he had touched me to check whether I had a gun or not. I had the gun in front of me and he could not have noticed whether I had the gun or not", Pajaziti declared in court on 24.01.2025.
Further, the same person stated that the whole incident had started with a friendly conversation but then came the sentence "Why are you being so rude?"
"After we sit at the table with Dukagjini, on the left side and another person sits next to him, and another person opposite on the right side, Dukagjini approaches me and we start talking. First, we ask about each other's families and how things are going in general. At that moment, the security guard Hyseni Geci approaches and asks me if everything is okay, I told him that everything is okay, just think about it and sit at the table. And he turns to look at Dukagjini and I was surprised by his silence and the way he looked at me," Pajaziti continued.
In the courtroom, Pajaziti said that a person named Hisni Geci had held the person's gun in his hand with the intention of not shooting him, but that later Pajaziti said that he felt a strong blow to the head and thought that this blow was from the gun.
"What the hell, they killed you" - were the words that Pajaziti said he heard from someone after feeling the strong blows to the head.
Pajaziti said that after that he didn't remember anything, except for some police sirens.
"At that moment, Dukagjini comes close to my ear and says 'why are you being a jerk', I was stunned and scared because I didn't expect such a word from him, I heard very well what he said to me. But he didn't listen and I said 'what are you saying, I don't listen', I thought I wouldn't repeat that word. He said to me 'you listen very well, but why are you being a jerk, do you know that I can do this-that' and he took out the gun he had between his legs. And I told him not to be shy, and at that moment, security guard Hisni Geci enters, who puts Dukagjini's right hand in the hand where he was holding the gun to prevent him from shooting at me. And he puts his left hand behind my back, at that moment, I thought that the best possible way is to get out of there. I felt very scared when I saw his gun, but my escape was prevented by Hys' hand behind my back, and it was a matter of time.
At that moment, I felt a strong pain in my head, which shocked me and I thought that this blow came from a gun and after this blow I lost all feeling about this case. And I don't remember many things except for some short sequences, where in one of them I remember Gëzim being told 'what the hell, they killed you'. And I remember some police alarms. And I only remember some white clothes, nothing more", Pajaziti confessed.
How was the murder committed according to the Prosecution?
According to the Prosecution's file, the case occurred on 04.08.2023 at around 23:15, where the defendant, who is on the run, Dukagjin Likaj, and the now deceased KR were previously sitting.
The file describes that Likaj was the one who had invited the accused Andi Pajaziti to sit at their table.
After the tension of the situation, according to the Prosecutor's Office, it was the security guard Hisni Gecaj who had tried to calm the situation, but had not succeeded.
The Prosecution file describes that the now deceased KR had attacked the accused Pajaziti twice in the head with a bottle.
After this attack, the accused had taken the gun from his belt on the right side, due to a strong mental shock, as described in the indictment "without his fault, without thinking about the consequences", he added a firearm in which case hits the already deceased KR
According to the Prosecution's file, Dukagjin Likaj also pulled out the gun, during this time Hisni Gecaj was holding his security hand, while the gun was pointed in the direction of the accused Pajaziti.
The file says that Dukagjin Likaj fired a gun at the defendant Pajaziti, in which case he "injured him in the elbow of his left hand" and as such they are part of serious bodily injuries with permanent health consequences.
KR's death, according to the Prosecutor's Office, was the result of internal and external bleeding which led to hemorrhagic shock, as a result of the firearm projectile.
The weapon that was used, according to the Prosecution, is a "Smith" type of 9mm caliber.
For this, the accused, in addition to committing murder, is also accused of carrying weapons without a permit.
Pajaziti is currently being held in pre-trial detention. Pajaziti was remanded in custody on 07.08.2023, along with suspects Hisni Gecaj and Gëzim Zakuti.
But Gecaj and Zakuti were released from this measure after the request of the Prosecutor's Office.
According to the Prosecutor's Office, in this case, the lives of other people who had suffered bodily injuries from firearm shells were at risk.
Andi Pajaziti and Hisni Gecaj were also injured, while KR did not manage to survive the gunshot wounds, who died in the KKUK.
