Several draft laws were approved in the Assembly during the session of December 5, 2024. However, the Constitutional Court repealed 13 of them on Friday, January 9.

This is because, according to them, the constitutional articles regulating the form of government and the separation of powers were violated. Among these decisions was the Law on Confiscation of Assets.


Its repeal is being welcomed by monitors of the work of the Assembly.

The Kosovo Democratic Institute (KDI) says that the same was a clear message for the future of Kosovo.

"I think it has given a clear message for the future that every legislative process, every legislative initiative that is processed in the Assembly must be processed according to the rules and procedures foreseen by parliament and in no way should these procedures be processed in a hurry," declared Vullnet Bugaqku from KDI.

Bugaqku says that the Constitutional Court should have made this decision earlier.

"It is a little concerning how the Court kept this draft law in proceedings for almost two years. For procedural reasons, the Constitutional Court could have issued these decisions and findings earlier," he says.

The lawyer, Asdren Bytyqi, is of the same opinion.

"Among the aspects that I consider to be key to being unconstitutional is the fact that two procedures cannot be conducted simultaneously, criminal and civil. I consider that the manner of establishing this organization, namely this Agency, is contrary to the Constitution and the Law, because in this case it is established by the Government and with the vote of the parliamentary majority, which could affect the independence and impartiality of this institution," he said.

This Constitutional Court decision was also welcomed by the Democratic Party of Kosovo, which had contested the procedure for approving the laws.

Meanwhile, the acting Minister of Justice, Blerim Sallahu, has said that the decision is illegal, unprofessional and unethical.

In the plenary session of December 5, 2024, the Assembly approved 20 laws, where the vote was held without the presence of opposition MPs. /Teve1/
