The founder confirms the indictment against Ilir Abdullah, accused of murdering Triumf Riza

The Basic Court in Pristina has confirmed the indictment of the Special Prosecution of the Republic of Kosovo (PSRK) against Ilir Abdullah. who is accused that in collaboration with Arben Berisha, Fitim Avdiu, Enver Sekiraqa and Rrahim Abdullahu, they killed the ex-policeman Triumf Riza.

Ilir Abdullahu pleaded not guilty at the initial hearing on September 18, 2024, saying that he does not accept an indictment based on hearsay, reports "Oath of Justice".

After the initial hearing, the accused Abdullah, through his defense attorney Ramë Dreshaj, submitted a request for dismissal of the indictment and opposition to the evidence. However, the Foundation has made a decision, with which it has confirmed the indictment.

Allegations of the defense of the accused Abdullahu:

In the allegations of the defense request, it is said that the indictment is not based on evidence that would argue the credibility of the indictment and that there is no evidence that would argue the well-founded suspicion that Abdullah committed the murder as alleged.

Also, the defense has claimed that the evidence, which according to them was extracted with violence and pressure in the pre-criminal procedure by a police investigator, proves exactly the opposite of what the indictment says.

According to the defense, in the provision of the indictment it is not known whether it is about revenge or for some other motive.

According to the defense, Abdullah is alleged to have committed the murder of Triumf Riza in collaboration with Arben Berisha, Fitim Avdiu and Rrahim Abdullahu, but it is not known that all of them jointly or any of them had a motive for revenge against Triumf Riza and that in the dispute revenge or other motives, the convict Enver Sekiraqa is not mentioned.

Also, the defense has claimed that in the indictment the time when it is claimed that Abdullah received the message "parking at Grandi, the neighbor had drama" (alluding to Triumf Riza) is wrong, since in the indictment against Sekiraqa the message is said to have been sent at 14:06 minutes, while in that against Abdullah at 13:02 minutes.

According to the defense, the evidence obtained in the investigation procedure during 2007 should be separated from the case files, since according to them they are clearly unsupported and are not in harmony with the legal provisions of the Code of Criminal Procedure.

Also, the defense requested that the statements of the witnesses: Besnik Hasani, Shpend Qerimi, Abedin Canolli, Besarta Mexhuani, Kaltrina Berisha, Faton Shoshi, Mona, Zanfina and Ema Ismajli, the statements of the victims: Adelina Ismjali and Emine Zeqiri.

All this, since according to the defense, the giving of statements in the pre-criminal investigative procedure was contrary to the Code of Criminal Procedure, on the grounds that the same were obtained under pressure, fraud and threats by the investigators at the time.

PSRK's response to Abdullah's defense claims:

Regarding these claims, according to the Court's decision, the Special Prosecutor's Office has provided an answer by proposing to reject the request of the defense for dismissal of the indictment and opposition to the evidence.

According to the PSRK, the indictment was filed after a complete and comprehensive investigation where important material evidence and witness testimony were collected and that according to the Prosecution Abdullah's actions show that he committed the criminal offense for which he is accused.

Findings of the Basic Court in Pristina:

According to the Foundation, based on the case documents and the evidence on which the indictment is based, there is sufficient evidence that proves the well-founded suspicion at this stage of the criminal procedure.

Also, the Court clarifies that the indictment was filed in accordance with the law and based on articulate evidence, which supports the well-founded suspicion that Abdullah has committed the criminal offense of aggravated murder in complicity.

In the Court's decision, it is stated that during the trial of the case, it will take into consideration the facts of what criminal offense the other accused have been convicted of, whether the other accused have been found guilty of incitement-pushing as well as the element of complicity.

And that according to the Court, after reviewing all the claims, it will issue a decision because for now, the first instance assesses that the accusation has passed the criterion that supports the well-founded suspicion that Abdullah has committed the criminal offense, which makes it necessary to go to judicial review.

In the end, it is said that an appeal against this decision is allowed within 10 days.

What does the PSRK indictment say?

On September 2, 2024, the Special Prosecutor's Office of the Republic of Kosovo (PSRK) filed an indictment in the Basic Court in Pristina - Special Department, against the defendant Ilir Abdullahu, known by the nickname "Liza".

Abdullahu is accused of complicity with the now convicted Arben Berisha and Fitim Avdiu, as well as the defendants Enver Sekiraqa and Rrahim Abdullahu, as a group organized by Sekiraqa, driven by the motive of unscrupulous revenge, with the intention of depriving him of his life now the late Triumf Riza, for the reason that the now deceased, on December 24, 2005 in the bar "Swiss Casino" in Pristina, had now beat the convict Sekiraqa, where the latter had been lying in the hospital, that after the announcement with Adelina Ismaili, the same one did not allow him to give the racketeers - money as before.

Furthermore, it is said that for his arrest and beating in Ferizaj on May 22, 2006 by members of the KPS, Sekiraqa had accused the now deceased Triumf Riza of being pushed by him, therefore they have agreed that now deprive the deceased of his life.

In the indictment it is said that for some time they followed Riza's movements with cars and on August 30, 2007, while Arben Berisha, Enver Sekiraqa, Rrahim Abdullahu and Ilir Abdullahu were in the bar "Sekiraqa", the now convicted Avdiu, through his phone, now sent a message to the accused Abdullah with the content "Parking at Grandi, you had the drama", alluding to Riza, whose apartment was in front of the "Sekiraqa" bar, while at that time he was in the Grand Hotel.

According to the indictment, after receiving the notice, the now convicted Berisha and the defendants Ilir Abdullahu and Rrahim Abdullahu went by car to the bar "Quins", where the now convicted Berisha, previously armed with a pistol, entered a bar. while the defendant Ilir and the defendant Rrahim entered another bar to wait for Riza, since the latter was a guest of that bar almost every day.

Then, it is said that the defendant Rrahim Abdullahu, through his phone, sent a message to the now convicted Berisha, while he was sitting on the terrace of a bar near the AMPM bar, with the content "stay here, how are you, he called you later", after Riza was seen at the AMPM bar.

The indictment states that at the moment when Riza left the bar and was close to his vehicle, the now convicted Berisha ran towards him and in a sly way, when Riza did not expect any attack, with his back turned to him. from a distance of 5 meters, with a pistol he shot 11 times with three short bursts, hitting him with 2 bullets in the back, where the bullets, due to the dynamic action, penetrated through the aorta, heart and lungs, from which injuries he is dead, as he was hit by a bullet in the thigh of his right leg.

With this action, the accused Ilir Abdullahu, in co-perpetration with the convicts Arben Berisha and Fitim Avdiu, and the defendants Enver Sekiraqa and Rrahim Abdullahu, are accused of having committed the criminal offense of "Aggravated murder", from article 147, paragraph 1, subsections 3 and 9, related to Article 23 of the Temporary Criminal Code of Kosovo.

Ilir Abdullahu, known by the nickname "Liza", was arrested on July 16, 2023, after being wanted for years as a suspect for the murder of Triumf Riza.

Enver Sekiraqa is also being tried for Triumf Riza, accused of inciting the murder of the policeman. Sekiraqa on May 3, 2024 was sentenced to 25 years in prison. The same is found on the run.
