Ulcinj's Grand Beach will not be given to the Arab businessman, Milatović reverses the law

Jakov Milatović, president of Montenegro, has not decreed the law that would have provided for the lease of the Great Beach of Ulcinj for 99 years to an Arab businessman for the construction of tourist and residential facilities.

At the session of April 23, the Parliament of Montenegro adopted the Law on Ratification of the Agreement on Cooperation in the Field of Tourism and Real Estate Development between the Government of Montenegro and the Government of the United Arab Emirates.

The content of the Agreement on Cooperation in the Field of Tourism and Real Estate Development between the Government of Montenegro and the Government of the United Arab Emirates raises numerous questions regarding its compatibility with the constitutional and legal order of Montenegro, reports Telegraph.


The provision in Article 2, paragraph 2 of the Agreement, which implies that the selection of investors is carried out by the United Arab Emirates, without conducting a public tender procedure, raises the issue of its compatibility with the provision of Article 140, paragraph 3 of the Constitution of Montenegro, given that the aforementioned provision of the Constitution prohibits the distortion and restriction of free competition and the encouragement of an unequal, monopolistic or dominant position in the market.

Furthermore, Article 2, point 4 of the Agreement directly excludes the application of many Montenegrin laws, including the laws in force relating to public procurement, public tenders and state property, thus clearly suspending part of the Montenegrin legal order.

Also, the issue of the Agreement's compatibility with systemic laws in the field of competition protection and state aid control is raised, which was also discussed by the management of the Agency for the Protection of Competition.

Otherwise, these laws were approved on April 23 in the Parliament of Montenegro. Those agreements were opposed by Albanian MPs. /Telegrafi/
