PDK's appeal against the ECAP decision is rejected as unfounded

The Supreme Court has rejected as unfounded the appeal filed by the Democratic Party of Kosovo (PDK), filed against the decision of the Electoral Complaints and Appeals Panel (ECAP).
According to a media release, it is stated that after ECAP dismissed the complaint ZP.Anr.69/2025, dated 08.01.2026, as out of time.
"This political entity has filed an appeal with the Supreme Court, proposing, among other things, that the Supreme Court order the Central Election Commission to cancel all ballots received by mail after 29.12.2026, 16:00, and to exclude from the counting all ballots received by mail after this deadline, including those received on 02.01.2026 and 05.01.2026, as well as to review the election results without including these ballots," the announcement states.
It is further announced that the Supreme Court of Kosovo assessed the legality of the contested decision, and after reviewing the case files, found the appeal to be unfounded.
"The Supreme Court, based on the factual and legal situation of the case, fully accepts as fair and well-founded the legal position of the ECAP, with which it rejected as untimely the appeal of the political entity, the Democratic Party of Kosovo," the announcement states.
The Supreme Court considers that legal deadlines are a guarantee for the complaining party and an obligation for the responsible bodies to review complaints within the deadline, while the deadline for complaints in the electoral process in particular is vital for them to be concluded as such and for there to be no time extensions. /Telegraph/
