One of the owners of the Swiss bar where 40 people died in a fire on New Year's Eve has been taken into custody.

Swiss prosecutors announced that Jacques Moretti, a French citizen, posed a potential risk of leaving and was therefore taken into custody.

The fire at the Le Constellation bar in Crans-Montana left 116 people injured, most of whom were under 20, reports skynews.

Swiss authorities claim that the bar at the ski resort had not passed safety checks for five years.

Jacques Moretti and his wife, Jessica Moretti, also French and co-owners of the bar, have been placed under criminal investigation by Swiss prosecutors. Both are suspected of negligent homicide, negligent bodily harm and negligent arson, according to a statement from the Valais Public Prosecutor's Office.

The owners have stated that they will provide full cooperation with investigators.

Prosecutors believe the fire was started by fireworks in champagne bottles, which caused flames to ignite on the bar's ceiling. /Telegraph/
