In the trial of the former CEO of the Kosovo Energy Corporation (KEK), Nagip Krasniqi, witness Edmond Nulleshi testified before the trial panel, who now said that he is an electrical engineer by profession.

Nagip Krasniqi is accused of causing KEK 3 million euros in damage due to trading electricity with the Slovenian company "Holding Slovenske Elektrane", which according to the Special Prosecution Office was not licensed in Kosovo.


Nulleshi said that during 2022-2023 he held the position of executive director of KEK services.

The witness explained how the electricity trading between KEK and the HSE company developed during the years 2022-2023 during the time he was engaged in this process.

The witness said that he had been engaged in this process for a period of 3-4 months, and that the electricity trading process was carried out through daily auctions or based on needs.

"The trading process was carried out through daily auctions or based on needs whenever there was a surplus of electricity and whenever there was a need to import electricity from the Kosovo Energy Corporation, mainly when a unit had an unplanned drop in production," the witness stated.

According to the witness, trading was conducted through auctions and whenever there was a need to conduct trading, an invitation was sent to all parties with whom the Kosovo Energy Corporation had signed a general EFTA contract.

Further, the witness said that the HSE company had a signed EFTA general contract with KEK, but emphasized that this contract was in 2018.

The witness further stated that ERO had begun a monitoring process at KEK, while until 2022 the witness stated that he had no knowledge of whether ERO had conducted monitoring of this nature at KEK.

"Are you aware of the existence of the legal opinion prepared by the KEK legal office regarding the ERO's recommendation to cut off power and the response of this office that the ERO's recommendations are law and must be respected?" - prosecutor Dren Paca asked the witness.

"No, I have not seen this letter," the witness replied.

Further, the witness said that considering that ERO is an institution for providing legal interpretations, they agreed to cease trading with the HSE company.

Among other things, witness Nulleshi said that he is aware that the HSE company was previously a commercial agent for KESCO.

According to witness Nulleshi, in the state of Slovenia, electricity traders are not required to have an electricity trading license.

The witness said that this fact was stated in one of the letters that KEK had with ERO.

Witness Nulleshi said that KEK did not sign and has no right to sign reciprocity agreements.

According to the witness, ERO has reciprocity agreements with several countries, but as far as he knows, it does not have one with the Slovenian state.

Upon completion of witness Edmond Nulleshi's testimony, today's session was adjourned and the next one was scheduled for January 2026.

The trial panel in this criminal case is composed of Arben Hoti (chairman) and Ngadhnjim Arrni and Vesel Ismaili (members).

The indictment in this case is being represented by prosecutor Dren Paca.

The prosecution accuses Krasniqi of causing damage to KEK of over 3 million euros after the Electricity Regulatory Office (ERO) fined KEK 3.2 million euros due to Krasniqi's actions.

At the initial hearing held on 08.10.2025, the accused Nagip Krasniqi pleaded not guilty to the charge of abuse of official duty.

Even at the court hearing held on 03.07.2025, Krasniqi declared that he did not admit guilt.

Nagip Krasniqi was arrested on 19.04.2023 on suspicion of abuse of official position, exercise of influence and conflict of interest.

Krasniqi is being accused by the Special Prosecution Office of trading electricity with a Slovenian company, which was not licensed in Kosovo.

On this basis, the Prosecution claims that KEK has suffered damage worth over 3 million euros.

Krasniqi is accused of having begun abusing his official position from 15.10.2021 to 19.04.2023.

What did Nagip Krasniqi declare to the Prosecutor's Office?

According to the indictment provided by KALLXO, the defendant Nagip Krasniqi, in his defense given to the Prosecutor's Office on 05.07.2024, stated that from October 15, 2021 to April 19, 2023, he was the Chief Executive Officer at KEK.

Nagip Krasniqi, during his statement to the Prosecutor's Office, said that KEK had traded with all companies that had been licensed in Kosovo and in countries that had been members of the Energy Community, which according to the Law on Electricity did not need re-licensing in Kosovo, adding that "HSE" and other trading companies were also members of the European Electricity Trading Federation.

"Since 2018, KEK had a special contract for the trading of electricity with "HSE" and other traders, and "HSE" had made the regular accession of the Kosovo market to KOSST," accused Nagip Krasniqi said in the Prosecution.

Regarding the confirmation of energy purchases or sales before signing individual EFET contracts, the defendant Krasniqi stated that in some cases he had done it himself and in some cases the operations director Luigj Imeri and that the trading department did not answer directly to him but to the operations directorate.

“…the energy trade was carried out outside the territory of Kosovo and ERO had no jurisdiction over that trade, 2. Based on the Law on Electricity, Article 32 and 3, the exclusion of an operator would have an impact on the increase in purchase prices and lower sales prices, which would damage the company's interest and would burden the Government's subsidy fund more,” defendant Krasniqi said in the Prosecutor's Office regarding ERO's remarks.

Further, according to the indictment, regarding the opinion of the legal office regarding ERO's remarks on the interruption of trading with unlicensed operators and why he had not taken their opinion into account, the defendant had said that the main reasons were because the law on electricity allowed it and secondly, in conversations with the energy secretariat in Vienna, their verbal interpretation had been that the Law on Electricity allowed something like this and that companies should not be hindered in the free trading of electricity.

Meanwhile, regarding ERO's recommendation to cease trading with HSE, Krasniqi had stated that the recommendation was not an obligation and that he had considered that recommendation illegal and that if it were respected, the damage would be irreparable, adding that "HSE" should not have been treated as an unlicensed company since it was a state-owned company in Slovenia and Slovenia is a member of the Energy Community and that he had no connection with that company.

Regarding the opinion of the legal office dated 07.10.2022, he said that it was unclear and ambitious, and regarding the subsidies received from the government, he stated that they were used to cover the provision of universal service due to KESCO's inability to make those purchases due to its financial problems.

Krasniqi is suspected of having begun abusing his official position from 15.10.2021 to 19.04.2023, the day that coincides with his arrest.

According to a provision of the indictment obtained by KALLXO.com, Krasniqi had enabled a Slovenian company to trade energy in Kosovo, which did not have a license, thus damaging KEK to the tune of around 3 million 230 thousand euros.

"...so that he knowingly approves purchases, signs contracts and authorizes their signing, and confirms the continuation of trading with the operator in question, even though he was aware that electricity could not be traded with this operator until he was licensed or his license was recognized by the Energy Regulatory Office," the indictment states.

According to the indictment, these actions enabled the Slovenian company "Holding Slovenske Elektrane" - HSE to trade electricity in the Republic of Kosovo.

Among other things, this provision emphasizes that the same person is enabled to benefit financially and evade tax payments, damaging the Kosovo state budget in the amount of 531,920.79 euros.

"...and consequently the large-scale damage to the budget of the Republic of Kosovo or in the amount of 531,920.79 Euros, the damage or discrimination of other competing economic operators operating in the Kosovo market that were licensed and subject to tax obligations, as well as the causing of material damage to the Kosovo Energy Corporation on a large scale or in the amount of 3,229,905.00 Euros" - it continues.

Krasniqi had been in pre-trial detention since 20.04.2023, but was released five months later, on 15.09.2023.

Krasniqi's arrest was made by order of the Special Prosecution of the Republic of Kosovo.
