Today, December 10, 2025, Isni Kilaj was released on bail in Kosovo, with conditions set after the last review of his detention by the Judge.

According to a media release, in his decision of December 3, 2025, the Judge found that circumstances had changed since the review of Kilaj's detention in October 2025 and that his detention was no longer reasonable or proportionate.


"Although the Judge found that there was some risk that if released, Kilaj might obstruct the progress of the process or commit other criminal offenses, he concluded that in the specific circumstances Kilaj's fundamental right to liberty outweighs these risks," the announcement states.

Today, December 10, 2025, Isni Kilaj was released on bail in Kosovo, with conditions imposed following the latest review of his detention by the Single Judge assigned to the trial of the case of the Specialist Prosecutor v. Hashim Thaçi, Bashkim Smakaj, Isni Kilaj, Fadil Fazliu and Hajredin Kuçi (“Case 12”).

In his decision of 3 December 2025, the Judge found that the circumstances had changed since the review of Mr Kilaj’s detention in October 2025 and that his detention was no longer reasonable or proportionate. Although the Judge found that there was some risk that, if released, Mr Kilaj might obstruct the proceedings or commit other criminal offences, he concluded that in the specific circumstances Mr Kilaj’s fundamental right to liberty outweighed these risks.

Among other factors, the Judge considered that the time Mr. Kilaj has currently spent in detention exceeds the minimum sentence under the law that he would face if convicted of the criminal offenses with which he is charged. The Judge also considered that no evidence has been presented to show that Mr. Kilaj attempted to obstruct the process during the period of his previous conditional release in 2024; that the presentation of evidence in the case of the Specialist Prosecutor v. Hashim Thaçi, Kadri Veseli, Rexhep Selimi and Jakup Krasniqi has been completed; and that the risk that Mr. Kilaj could influence the Prosecution witnesses in Case 12 is very low given their specific circumstances. The Judge also found that there is no risk that Mr. Kilaj will abscond based on the period of his previous release and the substantial amount of financial bail that he would forfeit. Mr. Kilaj remains an accused in the current trial and several conditions have been imposed on his release that are intended to reduce the risk of him influencing witnesses in the trial against him or in other trial cases before the Specialist Chambers.

The decision stipulates that if Mr. Kilaj violates any of the conditions of his release, a warrant will be issued for his immediate arrest. /Telegraph/
