ESHA: Irregularities and systemic weaknesses were found in the work of the Basic Court in Gostivar

The Financial Statement Audit and Compliance Audit of the Basic Court of Gostivar, conducted by the State Audit Office, revealed numerous irregularities and systemic weaknesses.

"The lack of provisions for determining the salaries of court employees performing technical and support work has been noted, the funds allocated from the 2023 Budget for financing the Judicial Authority do not reach the legally established percentage of 0.8% of the GDP of the Budget of the Republic of North Macedonia, respectively, the approved funds represent 0.3% of GDP, in the module for calculating the salary of the judicial police, the salary increase is not included in the basic component on the basis of which the calculation of past work is made, while the allowances for overtime and night work, although not required, are included in the basis for calculating the work experience allowance," the Report states.

The State Audit Office has also noted different conditions for filling a single job position in the regulations under which the courts operate, which, according to it, causes dilemmas and inability to act, as well as that the form and content of the forms for keeping court deposits are not defined and there are inconsistencies in the legal and sub-legal acts in determining the ownership of outdated deposited cases after the expiration of ten years from their submission.


It was found that there is no documentation proving the right of ownership or use of the real estate, the building in which the court is located, the inventory has not been carried out in accordance with legal regulations, that a system for electronic recording of working hours and overtime has been established, but due to a malfunction it is not being used, and that no agreement has been concluded between the institutions for the percentage participation in the costs of joint use of the building. /Telegrafi/
