Indictment against six people for usury, illegal possession of weapons and obstruction of procedure, confiscation of vehicles is also proposed

The Basic Prosecution Office in Prizren announced on Friday that it has filed an indictment against three people suspected of the criminal offense of usury, against two other people suspected of the criminal offenses of usury and illegal possession of weapons, and against one person suspected of the criminal offense of obstructing evidence or official procedure.

"The Basic Prosecution in Prizren, General Department, has filed an indictment against J.Th., I.Th., A.Th., who are under detention since 02.10.2024, due to well-founded suspicion that they have committed the criminal offense "Usage" under Article 331 of the Criminal Code, LG, and DG, who are under detention since 25.02.2025, due to well-founded suspicion that they have committed the criminal offense "Usage" under Article 331, and each separately has committed the criminal offense "Unauthorized ownership, control or possession of weapons" under Article 366 of the Criminal Code, and Gj.Th., due to well-founded suspicion that he has committed the criminal offense "Obstruction of evidence or official procedure" under Article 386, according to the Criminal Code," the announcement states. The Prosecutor's Office, reports the Telegraph.

According to the indictment of the Basic Prosecution of Prizren, "the defendant J.Th., from May 2023, and continuously until October 2, 2024, in Prizren, intentionally and with the aim of illegally obtaining property for himself, contracts a clearly disproportionate amount of property in exchange for a service (giving a debt), taking advantage of the difficult financial situation of the injured party JA, where on the occasion of giving the money, the defendant warns him that for each delay he must pay 500 (five hundred) euros in interest, and by 02.10.2024, the interests owed to the defendant had reached the value of 20.000 (twenty thousand euros). On 02.10.2024 the defendant meets with the injured party who informs him that he has brought him the amount of 5.000 (five thousand euros) on behalf of interest, in which case he is arrested in flagrante delicto by the police. With these actions, J.Th. has committed the criminal offense of "Usurmency" according to the Criminal Code of Kosovo.

It is further stated that "the defendants I.Th. and A.Th., acting in collaboration, meet with the injured party, whom they warn that for each delay he must pay 500 (five hundred) euros in monthly interest, while later the weekly interest was 50 (fifty) euros and then changed, increasing to interest in the amount of 100 (one hundred) euros. As a result of these, the interest for the aforementioned defendants had reached around 11,000 (eleven thousand euros). With these actions, in co-perpetration they committed the criminal offense of "Usurpation" according to the Criminal Code of Kosovo".

"The defendants DG and LG, acting in collaboration, taking advantage of the difficult financial situation of the injured party JA, after initially giving him money with interest, the injured party due to his difficult financial situation, not having the opportunity to return the money, in June 2024, at the premises of the defendant DG, meets with the same person who, in the name of the amount of 2,500 euros, which also includes interest, gives the defendant DG a 2018 VW UP vehicle, which vehicle is significantly higher in price, for the amount of 2,500 euros that the injured party had to give to the defendants. With these actions in co-perpetration, they committed the criminal offense of "Usurpation" of the Criminal Code of Kosovo," the announcement states, reports Telegrafi.

Also, according to the Prosecution, the defendants DG and LG, each separately, committed the criminal offense of "Unauthorized ownership, control or possession of weapons" under the Criminal Code.

"The defendant Gj.Th., in the period from November 2024 to February 2025, in various locations in Prizren, has encouraged the witness JA, who also has the capacity of the injured party - the victim in this criminal case, to give a false statement, in order to facilitate the judicial process of his family members - defendants J.Th., I.Th., and A.Th., and their release from detention, so that the defendant has continuously requested from the injured party to change his statement given earlier against the defendants, and in exchange for changing the statement, the debt will be completely removed, promising that there will be no problems with the aforementioned defendants. With these actions, the same has committed the criminal offense of "Obstruction of evidence or official procedure" according to the Criminal Code of Kosovo," the announcement states, reports Telegrafi.

Also, the Prosecutor of the case has proposed the permanent confiscation of the vehicle and object with which the criminal offense was committed, as well as the confiscation of the items that enabled the commission of the criminal offense and which are material benefits obtained with the criminal offense "Usurpation", for which Final Prohibition Orders have been issued by the Court, namely the vehicle of the brand "Daimler Chrysler", the vehicle of the brand "Citroën", Mercedes-Benz, E 220d4 MATIC, BMWX5 jeep, Telephones, 2.400 euros, 330 Swiss francs, 50 dirhams (Arab banknotes). /Telegraph/
