The Kosovo Law Institute (KLI) calls on the Kosovo Prosecutorial Council (KPK), in accordance with its constitutional and legal powers, to announce the vacancy for a new Chief State Prosecutor.

IKL emphasizes that the announcement of this competition and the development of a merit-based process would be an adequate signal of positive signs of reform in the KPC.


“Kosovo has been without a Chief State Prosecutor since April 2022. Thus, it has now been four (4) years since the State Prosecutor has been functioning as an Acting Chief State Prosecutor. On October 17, 2023, the President of the Republic of Kosovo announced that she had not decreed the candidate proposed by the KPK for Chief State Prosecutor, returning this process to the KPK. Unfortunately, since then, the KPK has not acted towards developing a meritorious and transparent process for the selection of the candidate for Chief State Prosecutor.

The inaction of the KPK for years had exposed the corporatist way of acting within the KPK. Now that the KPK has become functional according to the new reform, among its first actions should be the announcement of the competition for the Chief State Prosecutor and the development of a transparent and meritorious process, so that the name of the Chief State Prosecutor does not emerge from a contested process. This request was also given in the latest report of the European Commission on Kosovo", the reaction states.

For this reason, IKL calls on the KPK to announce the vacancy for a new Chief State Prosecutor as soon as possible, filling this position which has remained vacant for nearly 4 years.

"On the contrary, the continuation of this situation would further deepen the institutional vacuum at the head of the State Prosecutor and would damage public trust in the independent and effective functioning of the KPK itself. Therefore, the KPK must act without delay to initiate and develop a regular, transparent and meritorious process for the selection of the new Chief State Prosecutor", it is stated, among other things, in the IKL's reaction. /Telegrafi/
