"I felt a strong pain in my head that shocked me..." This is how the accused Andi Pajaziti describes the day when KR was murdered at the 'Bon Vivant' bar in Pristina in the summer of 2023.
In this case, Pajaziti is accused of committing the murder in a state of severe mental shock.
At Friday's hearing at the Basic Court in Pristina, Pajaziti testified that he had not left the house until 9 p.m., as he said he had been emotionally shaken since morning.
And at this hour he said that his brother had taken him home, to go somewhere to eat.
The accused recounts the moments before and after the meeting with Gëzim Zakuti.
He points out that during a joint dinner, which he does not clearly remember who had initiated, Gëzim had accepted the invitation and joined in. After dinner, they had gone to Vranjefc to look at some cars with their friends, staying until around 11:00.
After that, he explains that they planned to escort Gëzim to his vehicle, which was located near the "Prishtina" hotel.
He further added that when they arrived at "the Neck", there was a column and, as he said, he suggested that they go to the "Bon Vivant" bar.
When they arrived at "Bon Vivant," Pajaziti said they were initially greeted in a friendly manner by security and then went inside, where they met the manager of the bar.
According to Pajaziti, Polloshka welcomed them and asked them to wait a bit until a table became available, due to the overload.
During the reception, Dukagjin Leka approached him and invited Pajaziti to his table, telling him he wanted to talk about something.
Pajaziti said he accepted the invitation, as he had known Dukagjin Leka for about 10 years and had never had any problems with him.
"...while waiting for a while, Dukagjin Leka approaches, and we greet each other and he tells me to come to the table and have a drink because I have something with me," said Pajaziti. Meanwhile, he further explained that he accepted Dukagjin Lekaj's offer because, as he said, he had known him for about 10 years and there had been nothing bad with him," said Pajaziti.
Andi Pajaziti said that he initially thought Dukagjini was calling him about a car that he had offered to sell two days earlier.
When they went to his table and sat down, he said he noticed Dukagjini touching his arms, but at the moment he didn't understand why he was doing this.
After the incident, he says he analyzed the situation and concluded that Dukagjini had attempted to search him to see if he had a weapon with him.
"I had the weapon in front of me and he couldn't notice whether I had it or not," Pajazit further stated.
According to him, after they sat at the table where Dukagjin Lekaj had invited them, two more people came, one on the left side and one person in front, where according to him they started talking to Dukagjin.
He then shows a moment when Dukagjin Lekaj addresses him with the words "why are you being a jerk?"
"...at that moment he said to me, "You've been very good to me, but why are you acting like a fool? Do you know that I do this and that?" and he took out the gun he had, holding it between his legs, and I told him not to rush, and at that moment security guard Hysni Geci entered, with whom he grabbed Dukagjini's gun with his right hand and tried to prevent him from shooting in my direction," Pajaziti recounts.
Andi Pajaziti said he considered leaving there, but was prevented from doing so by Hysni Geci (the venue's security).
"At that moment, I felt a strong pain in my head, which shocked me and I thought that this blow came from a firearm and after this blow, I lost all feeling and everything about this case and I don't remember many things. And, after this case, I only remember a few short sequences, where in one of them I remember Gëzim telling me, 'what the hell, they killed you' and I remember some police alarms and I only remember some white clothes, nothing more", this is how the accused concludes his confession.
After his speech, Pajaziti was questioned by his defense attorney Florent Latifaj, the prosecutor in the case Bukurije Gjonbalaj, judge Eroll Gashi, and the injured party's attorney.
Defense attorney Florent Latifaj asked Pajazit if he had previously known the now deceased KR.
"I don't even know the person the lawyer is asking exists, nor have I ever heard his name," said Pajaziti.
Latifaj also asked him if he had ever had any trouble with Dukagjin Lekaj and Hysni Geci, both of whom the accused said he had good relations with.
On the other hand, the injured party was asked by prosecutor Bukurije Gjonbalaj why he had the weapon with him on the critical day, where even though lawyer Latifaj intervened by saying that the weapon issue was legally closed, Pajaziti still gave his version.
Meanwhile, Pajaziti was asked by the representative of the injured party about the type of weapon, and he said he did not remember what kind of weapon it was.
Previously, in this session, four proposals were presented by the injured party's lawyer, who have withdrawn from this trial. The Court approved one of them, while three other proposals were rejected.
The closing statement for this session is scheduled for January 28th.
On June 21, 2024, the Basic Prosecutor's Office in Pristina filed an indictment against Andi Pajazit regarding the murder of August 4, 2023 in the "Bon Vivant" bar. Pajaziti is charged with the criminal offense "Murder committed in a state of severe mental shock" since, according to the Prosecution, due to the shock that the deceased KR had received since then, the accused, without his fault and without thinking about the consequences, took out his gun and shot in the direction of KR
Otherwise, in this case, N.Ll. was also detained, suspected of the criminal offense of "Providing assistance after the commission of criminal offenses", who was sentenced to one month's detention on September 5. After one month of this measure, the same person's detention was terminated, as there was no request from the Prosecution for the continuation of detention. Meanwhile, Gëzim Zakuti and Hisni Gecaj, as suspects for involvement in this case, were released from detention on August 29, 2023. The other suspect for involvement in this case, Dukagjin Nikollaj, is at large.
The Basic Prosecutor's Office in Pristina, on August 5, 2023, announced that all the suspects involved in the "Bon Vivant" case have a criminal past. However, the Minister of the Interior, Xelal Sveçla, has blamed the justice system for the murder in "Bon Vivant".
Regarding the August 4 incident, the Kosovo Clinical and University Hospital Service announced that 17 people were injured, and one of them died as a result of his injuries. The incident was said to have occurred as a result of a dispute between the defendants.
Kosovo Police confirmed in the early hours of August 5 that in the incident that occurred in a bar in the center of Pristina, there were people injured by gunfire, but also by broken glass. /Oath of Justice/
