KDI's Bugaqku: 10 MPs may address the Constitutional Court to unblock the Assembly

Vullnet Bugaqku of the Kosovo Democratic Institute (KDI) has assessed that the current political positioning for the election of the Speaker of the Assembly is further deepening the institutional blockade in the country.

Bugaqku stressed that the inability to secure a majority of 61 MPs is leading to deliberate political calculations by the Vetëvendosje Movement (LVV), which is seeking to buy time to convince other MPs or parties to support its candidate.

"It is a positioning that further causes a blockade, a continuation of a blockade of the formation of the Assembly. And this comes as a result of the inability to have the guaranteed vote of 61 deputies. In the absence of a political agreement, in this case the winning party of the elections seems to be calculating to waste a little more time. To eventually convince another deputy or party to vote for the Speaker of the Assembly and unblock the situation. And to enter the deadlines for the formation of the government," Bugaqku said for RTV Dukagjini.


According to him, in the absence of a political agreement, there is a real risk that this issue will end up in the Constitutional Court. He mentioned Article 113, paragraph 5 of the Constitution, which gives the right to 10 deputies to challenge any decision of the Assembly within 8 days, whether on the content or the procedure.

"Regarding the solution, I think that here we risk ending up in the Constitutional Court in this situation due to the fact that, if the LVV as the winning party of the elections and as the largest parliamentary group, continues to propose the same name and the same name does not receive enough votes. Then I see the possibility, it is my personal interpretation, legally that 10 deputies - the mandate of the deputy has begun at the moment when the oath is given. We have a provision in the Constitution of Kosovo, Article 113, paragraph 5, which states that 10 deputies within 8 days have the right to challenge any law and any decision in the Assembly. Both in terms of procedure and content. And now a decision means not only the passing of a matter in favor, but also when a candidacy is rejected or when a law or a certain decision is rejected. And I believe that a justification of a request on its admissibility in court could be made on this basis. By a group of deputies", Bugaqku added.

Bugaqku also mentioned two possible scenarios for getting out of the crisis.

"Or the second situation is to activate the president, she is constitutionally the guarantor of the democratic functioning of the institutions. And the same nothing nothing can do, I can call all the party leaders to a meeting. And there should be some kind of effort of an agreement to unblock the issue of electing the Speaker of the Assembly. And the third situation is that the LVV should change its candidacy, it should adapt, conditionally, to some signals that are coming from the AAK and the PDK.
