'Banjska' case, witness from North Macedonia begins testimony via video link

At the Basic Court in Pristina, on Wednesday in the session nThe three defendants in connection with the terrorist attack of September 24, 2023 in the village of Banjska, Zvečan: Vladimir Tolic, Dusan Maksimovic and Blagoje Spasojevic, are being heard by witness Goran Tanevski.
This witness is being heard via video link from North Macedonia, reports "Oath of Justice".
The Basic Court in Pristina, after the proposal of the special prosecutor Naim Abazi that the trial continue in absentia, had addressed the Supreme Court to request an opinion on whether the trial in absentia could be applied in the “Banjska” case. However, the Supreme Court, after reviewing the request “for a legal opinion regarding Article 303, paragraph 7 of the Criminal Procedure Code in the “Banjska” case”, had clarified that it does not provide legal opinions on the dilemmas that the first instance has during the proceedings of the case.
Thus, the Basic Court in Pristina has issued a decision, by which it has rejected the proposal that the trial of the other 42 defendants (41 natural persons and one legal entity) accused of the terrorist attack in “Banjska” continue in absentia. The court also announced that an international arrest warrant has been issued for these defendants and their detention and extradition are expected for the conduct of the procedure against them.
The trial of the three defendants in the "Banjska" case: Vladimir Tolic, Dusan Maksimovic and Blagoje Spasojevic, was held on April 17, 2025, in which the three defendants pleaded not guilty. Meanwhile, special prosecutor Naim Abazi, the defense of the defendants and the injured party gave their opening statements.
Even at the initial hearing held on October 9, 2024, the three defendants pleaded not guilty.
Otherwise, the Basic Court in Pristina - Special Department, with the ruling of December 6, 2024, had rejected as unfounded the requests for dismissal of the indictment and the objections to the evidence, submitted by the defense lawyers of the aforementioned defendants against the indictment of the Special Prosecution of the Republic of Kosovo.
Meanwhile, the Court of Appeals announced on March 13, 2025 that it had issued a decision, confirming the ruling of the Basic Court in Pristina, which confirmed the indictment against the defendants in the "Bajska" case.
So far, those arrested and under detention in this case are: Blagoje Spasojevic, Vladimir Tolic and Dusan Maksimovic, for whom criminal proceedings have been initiated.
The indictment of the Special Prosecution charges 44 individuals and one legal entity, “RAD DOO.” The list of defendants is headed by Milan Radoićić.
The Special Prosecution Office of the Republic of Kosovo (SPRK) on September 11, 2024 filed an indictment against Milan Radoičić and 44 others for the terrorist attack of September 24, 2023 in Banjska, Zvečan. The defendants are charged with attempting, through the use of violence with heavy weapons, to separate the northern part of the territory of the Republic of Kosovo and annex it to the Republic of Serbia, in which case, as a result of the violence used, police officer Afrim Bunjaku was killed and the lives of other police officers and the civilian population were endangered. In Bajsnka, Zvečan, in the early hours of September 24, 2023, Sergeant Afrim Bunjaku was killed and two others were wounded. Three more attackers were later killed, while the others fled after taking refuge for several hours in the Bajsnka Monastery. Milan Radoićić claimed responsibility for the terrorist attack.
